SALE
Once you provide our office with instructions we can have a contract to you and your agent anywhere from 1 hour to 4 business days. The length of time will depend on which council area your property is situated in and the number of searches required.
Once you appoint our office, it is like set and forget. We will ensure that you fulfil each of your obligations. We take out the stress and guesswork out of Conveyancing.
Selling Steps.
Appoint Conveyancer –> Appoint Agent –> Property presentation & marketing –> Agent finds a buyer –> We liaise with the purchaser Conveyancer/Solicitor –> Exchange contracts –> Post exchange obligations –> Settlement

The preparation of the contract is the first step in the process. Your agent must have a “Contract for Sale” prior to the agent discussing, advertising or showing your property to any potential buyer.

You should not compromise on who you chose to act for you.

PURCHASE
There are two ways to exchange a contract for Sale.
1. Exchange Contracts with a 5 day cooling off period.
Once exchange has taken place the purchaser has until 5pm on the 5th business day to rescind (cancel) the contract.
The 5 day cooling off period is a great time to complete all due diligence by obtaining searches, enquiries, strata inspections, building and pest inspections reports, bank valuations and unconditional loan approval.
If the purchaser is not satisfied with the results of any of the above you may rescind the contract for any reason, even change of mind.
If the purchaser chooses to exercise their right to rescind the contract, their representative will prepare and serve the appropriate notice and the purchaser will forfeit to the vendor 0.25% of the purchase price.
Alternatively if they wish to proceed with the property purchase, the purchaser will pay the balance of the deposit (if they have not already) and no further action is required.
The sold sticker goes up and celebration is in order!
2. Exchange contracts Unconditional (no cooling off period – 66W)
When a contract is exchanged with a Section 66W certificate and a 10% deposit is paid the contract is unconditional and there is NO cooling off period.
Upon exchange you are bound by the terms of the contract immediately and for this reason you must be very careful.
Only a licensed Conveyancer or Solicitor may sign and provide you with Section 66W certificate and they have obligations to fulfil prior to issuing one.
You must be completely satisfied with the property, its inclusions, the building, strata, enquiries for renovations, development approvals, pets, parking…. everything. Your Conveyancer will take you through the contract and your legal obligations.
It is imperative that you speak in detail with your banker or broker to confirm they will lend on this specific proper and provide you with unconditional approval.
As you are bound unconditional at exchange with no cooling off period If you don’t proceed to settlement you will forfeit your 10% deposit to the vendor
Auction
An auction contract is unconditional, which means no cooling off period therefore you must conduct all your due diligence prior to the auction day.
The contract must have been reviewed and explained to you by your Conveyancer. Any changes must be requested through the vendors Conveyancer/Solicitor prior to the Auction.
Prior to the Auction ensure you conduct all your property inspections and enquiries including and not limited to Strata, Pest, Building, Engineers, Valuations, Architects.
For Sale/Private Treaty/Expressions of Interest
Once you have negotiated a price and the terms of the sale you can either exchange unconditionally or if negotiated with the vendor they may agree to a cooling off period.
Unlike Auction you can conduct all the required due diligence during your negations or once your offer has been accepted.
A disbursement is an out of pocket expenses that your Conveyancer incurs on your behalf during your matter. A Conveyancer may request reimbursement during the matter or at completion.
Stamp duty is due at settlement or at 3 months after the date of the contract, whichever date occurs first.
Ensure that you speak to your broker or banker before you start looking at properties. You should have pre approval prior to making offers and unconditional approval before exchanging contracts.
It is recommended that you speak to the estate agent in regards to how they are running the campaign and what their expectation are. Then liaise with The Conveyancing Group to establish your next legal steps and requirements.
